TL;DR: This is beta software. It might break. We might change everything. We might shut it down. Gist has two main features: Gist summaries (AI-powered summarization of articles and videos) and Auto-Suggest (recommends content to summarize). When you click the Gist button, we process the content, cache the summary, and delete the original. If you don't interact with Auto-Suggest, nothing leaves your device. If you interact with it, we collect page metadata (including the URL) to improve recommendations — but never the page content. If — and only if — you enable Debug Mode, you are in the Eye of Sauron. You can disable Auto-Suggest entirely and blacklist domains. Don't be a jerk. We own everything we create. If you sue us, the most you can get is what you paid us (probably nothing).
1. Welcome to the Beta
These Terms of Service ("Terms") govern your use of the Beta version of Gist, a Chrome browser extension operated by Mireles & Co, LLC, dba Transcendence, Inc. ("we," "us," "our").
By installing or using the Beta version of Gist, you agree to these Terms. If you don't agree, don't use it. Simple.
2. What Gist Beta Does
Gist has two core features — Gist summaries and Auto-Suggest — plus a diagnostic tool called Debug Mode. Each has a different data profile.
2A. Gist Summaries
Gist's primary function is AI-powered summarization of articles and videos.
What happens when you click the Gist button:
1. The full source content is sent to our servers
2. We route it to our AI providers (Google Gemini and Anthropic Claude via AWS Bedrock) for summarization
3. The AI-generated summary is returned and cached in your content library
4. The original source content is deleted from our servers
We keep the summary. We do not keep the content you scraped. We do not use source content to train AI models during standard use.
Both AI providers are on paid API tiers, which means they are contractually prohibited from using your data to train their models.
2B. Auto-Suggest
Auto-Suggest analyzes the pages you visit to recommend content worth summarizing. It shows a bar at the bottom of the page when it thinks you'd benefit from a Gist.
How it works on-device: Auto-Suggest runs entirely on your device. It evaluates page features — things like DOM structure, number of links, and layout characteristics — to decide whether to show a suggestion. If you ignore the bar, no data leaves your device.
What happens when you interact: If you click or dismiss the Auto-Suggest bar, we collect:
- Page metadata: the URL, DOM structure features, and similar structural signals. We do not collect the actual text content of the page.
- Your interaction signal: whether you clicked, dismissed, or otherwise engaged.
How we use Auto-Suggest interaction data:
- Personalization: Your interaction history improves which pages Auto-Suggest recommends for you.
- Collaborative filtering: We use interaction patterns in aggregate across all users to improve recommendation quality globally.
- Model training: We train a recommendation model using interaction data and page metadata to improve Auto-Suggest accuracy.
Domain blacklisting: You can blacklist specific domains from Auto-Suggest in your settings. If you blacklist a domain, we receive the blacklisted domain so we can suppress recommendations on those pages. We also use aggregate blacklist data to improve recommendations globally.
Your controls over Auto-Suggest:
- Disable Auto-Suggest entirely — no interaction data is collected
- Blacklist specific domains from showing Auto-Suggest
- Tune Auto-Suggest sensitivity and behavior in settings
2C. Debug Mode
Debug Mode is a separate diagnostic tool covered in Section 16. It is never enabled by default and requires explicit opt-in. If — and only if — you enable Debug Mode, you are in the Eye of Sauron.
Beta Disclaimer: This is the beta version of our software. That means:
- Features will change without notice
- Things will break
- We might delete everything and start over
- We might shut down entirely
- There's no guaranteed uptime or reliability
- You're essentially a guinea pig (thanks for that!)
3. Your Account
Eligibility
- You must be at least 16 years old
- You sign in via Google Login
- One account per person
- You're responsible for your account security
Account Termination
We can terminate your account at any time for any reason, including but not limited to:
- Violating these Terms
- Being abusive to our team
- Using the service for illegal purposes
- Broad discretion during the beta period
4. Acceptable Use
Do These Things:
- Use Gist to summarize content you have the right to access
- Provide feedback to help us improve
- Report bugs when you find them
- Be patient with beta software
Don't Do These Things:
- Scrape copyrighted content you don't have access to
- Use Gist for illegal purposes
- Reverse engineer our extension or backend
- Attempt to overwhelm our servers
- Resell or commercialize our service
- Use automated tools or bots with our service
- Violate any website's terms of service while using Gist
- Scrape sensitive personal information
- Be a jerk to other users or our team
Violation = Instant Ban. No warnings during the beta period.
5. Content Ownership
Your Content
You retain ownership of the content you scrape.
Standard Use License: By using Gist, you grant us a limited, non-exclusive, worldwide license to:
- Transmit and process your content for the purpose of generating summaries
- Cache and store the generated summaries
- Collect and use page metadata and interaction signals from Auto-Suggest interactions to personalize your experience and improve recommendations for all users (collaborative filtering)
- Use aggregate, blacklisted domain data to improve recommendation quality
- Analyze aggregated, anonymized usage data for product improvement
- Train and improve our Auto-Suggest recommendation model using your interaction data and page metadata
This license is limited to what is necessary to provide and improve the service. We delete original source content after summary generation. We do not use source content to train AI models during standard use.
Debug Mode License: If you enable Debug Mode (see Section 16), you grant us an additional, broader license to:
- Retain the original source content you scrape while Debug Mode is active
- Track pages you visit and detailed session activity while Debug Mode is active
- Use data collected during Debug Mode to train, fine-tune, or evaluate AI models
- Retain data collected during Debug Mode after you disable it for the purposes of model improvement and debugging
This broader license applies only to data collected while Debug Mode is enabled. It survives disabling Debug Mode because we need the data to fix the issues that caused you to enable it in the first place.
Our Content
We own:
- All summaries generated by our AI
- The Gist extension and all its code
- Our recommendation models and algorithms
- Our backend infrastructure and APIs
- Our website and branding
- Any improvements we make based on your feedback
Feedback
Any feedback, suggestions, or ideas you provide become our property. We can use them without compensation or attribution. Don't share ideas you want to keep secret.
6. Payment Terms
Beta Pricing
- Currently free or pay-what-you-want
- We might charge you later
- All payments are final (no refunds during the beta period)
Future Pricing
When we exit the beta period, we'll implement real pricing. Early beta users might get a discount. Or not. We haven't decided yet.
7. Privacy and Data
See our [Privacy Policy](/privacy) for the full details. The short version:
- Clicking the Gist button sends the full article or video for processing; we keep the summary and delete the original
- If you don't interact with Auto-Suggest, nothing leaves your device
- Auto-Suggest interactions send page metadata (including URLs) — never page content — and are used for personalization and collaborative filtering
- If you enable Debug Mode, we collect significantly more data (with your explicit consent)
- We use paid AI services (Google Gemini, Anthropic Claude) that are contractually prohibited from training on your data
- You can disable Auto-Suggest entirely and blacklist specific domains
8. Third-Party Services
Gist integrates with various third-party services:
- Firebase (authentication via Google Login)
- Google Gemini (AI summarization — paid API tier)
- Anthropic Claude via AWS Bedrock (AI summarization — paid API tier)
- Cloudflare (hosting, edge computing, analytics)
- Amplitude (product analytics)
- Stripe (payments, when applicable)
- Others as we add them
Each has their own terms and privacy policies. We use paid API tiers for our AI providers, which means they are contractually prohibited from using your data to train their models.
9. Disclaimers (The Legal CYA Section)
GIST BETA IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- RELIABILITY, AVAILABILITY, OR ACCURACY
Specifically:
- We don't guarantee the extension will work
- We don't guarantee summaries will be accurate
- We don't guarantee your data won't be lost
- We don't guarantee we won't get hacked
- We don't guarantee anything, really
USE AT YOUR OWN RISK.
10. Limitation of Liability
OUR MAXIMUM LIABILITY TO YOU IS THE AMOUNT YOU'VE PAID US (PROBABLY $0).
We're not liable for:
- Lost data
- Lost profits
- Inaccurate summaries
- Service interruptions
- Any indirect, incidental, or consequential damages
If you're not comfortable with this risk, don't use Gist Beta.
11. Indemnification
You agree to indemnify and hold us harmless from any claims arising from:
- Your use of Gist
- Content you scrape
- Your violation of these Terms
- Your violation of any website's terms
- Your illegal activities
If someone sues us because of you, you pay our legal bills.
12. DMCA and Copyright
If you believe Gist is being used to infringe your copyright:

We'll respond as required by law. During beta, we might just delete everything related to the claim to avoid hassle.
13. Modifications to Terms
We can change these Terms anytime. During the beta period, we might not even notify you. By continuing to use Gist after changes, you accept the new Terms.
After the beta period, we'll give reasonable notice of material changes.
14. Termination
You Can Leave Anytime
Just uninstall the extension. We'll retain your cached summaries per our Privacy Policy.
We Can Kick You Out Anytime
We reserve the right to:
- Terminate your account
- Block your access
- Delete your data
- Refuse service
All without notice or reason during the beta period.
15. Dispute Resolution
Governing Law
These Terms are governed by California law, without regard to conflict of law principles.
Venue
Any disputes must be resolved in California courts. You consent to personal jurisdiction in California.
No Class Actions
You agree to only bring claims in your individual capacity. No class actions, class arbitrations, or representative actions.
Time Limit
Any claim must be brought within one year of when it arose.
16. Debug Mode
Debug Mode is a diagnostic feature that you may be asked to enable when you contact our support team. It is never enabled by default. If — and only if — you enable Debug Mode, you are in the Eye of Sauron.
How It Works:
- You enable Debug Mode manually through a clear opt-in process
- A prominent banner is displayed on your settings page while Debug Mode is active
- You can disable Debug Mode at any time
What Changes When Debug Mode Is On:
- We retain the full source content you scrape (instead of deleting it after processing)
- We track the pages you visit and detailed session activity
- We may use data collected during Debug Mode to train, fine-tune, or evaluate our AI models and client-side heuristics
What Happens When You Turn Debug Mode Off:
- We stop collecting the additional data described above
- Data already collected during the Debug Mode session is retained for debugging, model improvement, and evaluation purposes
Debug Mode exists because when something goes wrong, we need the data to figure out why. Enabling it is your explicit consent to the broader data collection described above.
17. Beta-Specific Terms
During the beta period:
- No SLA or uptime guarantees
- Features may be added or removed without notice
- We may reset all user data
- We may invite or remove users at our discretion
- We may end the beta at any time
- You're helping us test — thank you!

19. Miscellaneous Legal Stuff
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between us.
Severability: If any provision is unenforceable, the rest remains in effect.
Waiver: Our failure to enforce any provision isn't a waiver of our right to do so later.
Assignment: We can assign these Terms to anyone. You can't.
Force Majeure: We're not liable for failures due to circumstances beyond our control.
Survival: Sections that should logically survive termination (like indemnification and the Debug Mode license) do survive.
Export Control: Don't use Gist in violation of U.S. export laws.
Government Users: If you're a government user, sorry, Gist is only for commercial use.
20. Special Beta Thank You
Seriously, thank you for being a beta tester. You're helping us build something awesome. We know beta software can be frustrating. We appreciate your patience and feedback.
21. The Bottom Line
This is beta software from a small team. When you click the Gist button, we process the content, keep the summary, and delete the original. If you don't interact with Auto-Suggest, your data stays on your device. If you interact with Auto-Suggest, we collect page metadata to improve recommendations — never page content. If — and only if — you enable Debug Mode, you are in the Eye of Sauron. You have controls over all of this. We're doing our best, but we make no promises.
By using the Beta version of Gist, you acknowledge that you've read these Terms, understand them, and agree to be bound by them. If you don't agree, please uninstall the extension.
